Terms of Service

Welcome to Kano ("Company", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of the Kano service, delivered via iMessage and any associated platforms (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please refrain from using the Service.
1. Eligibility and Acceptance
You must be at least 13 years of age to use the Service. If you are between 13 and 18, you may only use the Service under the supervision and consent of a parent or guardian. By using the Service, you represent that you meet these requirements. Continued use after updates constitutes acceptance of the revised Terms.
2. Use of the Service
You agree not to misuse the Service, including attempting to access data without authorization, interfere with security, or use automated scripts to collect information. You are responsible for any content or communications you submit through the Service.
3. User-Generated Content
You retain ownership of any content you submit. By sending messages or uploading content through the Service, you grant Kano a worldwide, non-exclusive, royalty-free license to use, reproduce, and display it for the purpose of operating and improving the Service.
4. Third-Party Services
The Service may integrate with third-party platforms. Your use of those platforms is subject to their own terms and policies. We are not responsible for any third-party content, performance, or outages.
5. Fees, Payments, and Refunds
Some features require payment. By submitting a payment method, you authorize us and our payment processors to charge applicable fees. Subscription plans renew automatically unless canceled before the next billing period. You are responsible for all applicable taxes.
Unless expressly stated otherwise in writing, all purchases, fees, and charges are final and non-refundable. Canceling a subscription prevents future renewals but does not entitle you to a refund for the current term. If a free trial is offered, you must cancel before it ends to avoid charges.
We may, at our sole discretion, issue a one-time refund or credit in limited cases such as duplicate charges or verified technical errors. Any such accommodation does not create an obligation to do so again.
6. No Medical, Nutritional, or Professional Advice
The Service provides general fitness and nutrition coaching support for informational and accountability purposes only. It does not offer medical, dietary, psychiatric, psychological, or therapeutic advice, and is not a substitute for professional diagnosis, treatment, or emergency intervention. Nothing communicated through the Service should be construed as medical or clinical guidance.
You are solely responsible for your own health decisions, physical training, dietary choices, and any outcomes arising from your use of the Service. Before beginning any new fitness or nutrition program, consult a qualified healthcare or medical professional, particularly if you have pre-existing conditions or injuries. To the fullest extent permitted by law, Kano is not liable for any injury, illness, adverse health outcome, or other harm resulting from your decisions or conduct while using the Service.

7. Communications Consent
By providing your phone number, you consent to receive messages from us via iMessage and SMS, including coaching check-ins, reminders, account updates, and promotional content. You may opt out of non-essential messages at any time by replying STOP. Standard message and data rates may apply.
8. Privacy and Data Use
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to those practices.
9. Termination and Data Retention
We may suspend or terminate your access to the Service at any time, with or without notice. Upon termination, your right to use the Service will cease immediately. We may retain certain information as required by law or for legitimate business purposes such as fraud prevention or dispute resolution.
10. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
11. Limitation of Liability
To the maximum extent permitted by law, Kano and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use or inability to use the Service.
12. Indemnification
You agree to indemnify and hold harmless Kano and its affiliates from any claims, losses, or damages arising from your violation of these Terms or misuse of the Service.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising from these Terms.
14. Severability and Entire Agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms constitute the entire agreement between you and Kano regarding your use of the Service and supersede any prior agreements.
15. Changes to These Terms
We may modify these Terms at any time. Any updates will be posted with the "Last updated" date revised accordingly. Your continued use of the Service after changes take effect indicates your acceptance.
